If your marriage is starting to bend,  only you or your spouse can say whether it can be saved.  If only one of you says it can't be saved, the other one, by law, can ask the court to order some  marriage counseling.  

But if the other party says the marriage can't be saved, then a divorc will be granted.  That is the reason given under the law for a divorce.  This is a "no fault" state, so no one can legally blame anyone -- at least in regard to the breakup of the marriage itself.    Adultery, for instance is not taken into account by the court when making its ruling on issues in the case
(What we put in the Divorce Petition is:  "the legitimate objects of marriage have been destroyed and there remains no reasonable possibility that this marriage can be saved;  counseling should be waived." )

Behavior of the parents does count, though, in when it comes to the court's ruling on child custody.

In Iowa, when you wish to file for a divorce, you file a "Petition for Dissolution of Marriage" with the clerk of the courthouse in your county and pay a filing fee of $185.
(Dissolution of Marriage is another name for "Divorce".)

Then in order for the Court to have "jurisdiction" over your case, the court must have formal notice that your spouse knows that you have filed for divorce.  The Nan Tiernan Law Firm can make sure that your spouse properly receives the necessary papers to show that you have started divorce proceedings. Then we can proceed with your case.
Because your case is so unique, I will not detail all the ways there are to proceed.  But your case will either be an "uncontested" one or a "contested" one.  If it is "uncontested"  you and your spouse have worked out ALL the details of your separation and break-up.  If it is "contested" you still have disagreements over some things.  If the parties disagree, it is usually over property settlement and child custody issues.

A big thing to know is this.  A divorce is a court process so there are orders which move it along.  There are a number of court orders issued in the Dissolution of Marriage Process.  If you don't follow these orders, the case may be dismissed or the other side may get everything he/she wants  or you may have to pay a fine.  So pay attention.

In Polk County the orders will be:  1)  An order for a Pre-Trial Hearing where you bring a financial statement, a completed children in the Middle certificate, and a child support worksheet;  2)  an order to take a class called "Children in the Middle";  an Order for Mediation; 
3) A Trial Scheduling Order which gives you the date of the trial and what you have to do before it.

In Iowa you usually have to wait 3 months to get a divorce.  During that time you usually divide some of the property, talk about what else needs to be split, decide on what needs to be done regarding division of the equity in the family home, and experience how to take care of your children as a person who is separated from your children's other parent.  During that time also, you may mediate, or you may want to agree with the other party to hire a custody evaluator who will come up with an opinon about which parent would best serve the best interests of the children;  or you may want to engage an attorney who represents the best interests of your children - - called a "Guardian Ad Litem"
